Skrivr Terms of Service

Thank you for using Skrivr.
These terms of service (the "Terms") represent an agreement between you and Skrivr ("we", "our" or "us"). By accepting the agreement you are promising and agreeing also to follow and accept the other rules which Skrivr publishes on its website (the "Service"). If you are using the Service on behalf of an organization, you are agreeing and promising that you have the authority to bind that organization to the Terms. In such case "you" and "your" will refer to that organization.
You may use the Services only in compliance with these Terms. You may use the Services only if you have the power to form a contract with Skrivr and provided you are not hindered under any applicable laws from doing so. The Services are not intended for use by you if you are under 13 years of age. By agreeing to these Terms, you are representing to us that you are over 13.
The Services may continue to change over time and Skrivr reserves the right to make changes to these Terms if Skrivr deems it necessary or if it is required by law. In that case, Skrivr will notify you if required by law. If you do not accept such change, you may terminate your account with immediate effect at any time before the change becomes effective. You can easily terminate your account from your settings page. By using the Service you accept these Terms and agree to comply with them.
Skrivr reserves the right to solely decide on the content of the Service without any prior notice to you or other users. Your account and your use of Skrivr constitutes a part of a service provided to you on Skrivr's website and you only receive a right to use the Service according to these Terms and the terms and guidelines on the website from time to time.
Restrictions on use
You agree to use the Service in accordance with the guidelines on the Skrivr website as published from time to time. For example you may not;
- probe, scan, or challenge the vulnerability of any system or network;
- breach or otherwise circumvent any security or authentication measures;
- access, tamper with, or use non-public areas of the Service you have not been invited to;
- interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services;
- plant malware or otherwise use the Services to distribute malware;
- promote or advertise products or services other than your own without appropriate authorization;
- publish or send any unsolicited communications, promotions or advertisements, or spam;
- publish or send altered, deceptive or false source-identifying information, including "spoofing" or "phishing";
- publish anything that is defamatory, fraudulent, misleading, or infringes another's rights;
- publish or share materials that are unlawfully pornographic or indecent, or that advocate bigotry, religious, racial or ethnic hatred;
- violate the law in any other way than already mentioned above.
You are solely responsible for your conduct, the content of your files and folders, and your communications with others while using the Services. For example, it's your responsibility to ensure that you have the rights or permission needed to comply with these Terms.
You, are responsible for maintaining and protecting all of your content. Skrivr will not be liable for any loss or corruption of your content, or for any costs or expenses associated with backing up or restoring any of your content. You must not upload spyware or any other malicious software to the Service.
Your Skrivr account is neither inheritable nor transferable. If you allow third parties to use and access your account you are responsible for all acts of these parties in relation to Skrivr and to these Terms.
Cost of the Service and terms of payment
Skrivr reserve its rights to charge for the Service, the price and the payment terms will be indicated on the Service from time to time.
You own the rights to the material that you have created on the Service. In order for Skrivr to carry out the Service, you hereby give us a transferable irreversible right to dispose over all material you have posted on your account in accordance with your instructions from time to time, as well as to right of Skrivr to engage trusted third parties to assist Skrivr. We appreciate when users send us feedback, by doing so you also grant to us right to use any such feedback, comments, or suggestions you send us or post in our forums, without any obligation to you.
You give Skrivr the permission to approach you for an additional license to publish your content separately on the Skrivr website or associated Skrivr websites for content distribution. The terms of such additional license is voluntary and will be negotiated separately; these Terms do not force you to accept any additional licenses.
In relation to Skrivr you agree and guarantee that you are responsible for clearance of anything you have created through and subsequently host on the Service. You will be fully responsible and liable for what you copy, share, upload, download or otherwise use while using the Services.
You may not use Skrivr's intellectual property without the explicit prior written consent from Skrivr. This means that you may not copy, distribute, disseminate, sell, publish, send or otherwise circulate Skrivr's intellectual property (such as trademark, computer program, look and feel etc) to another person without the written consent of Skrivr. Nor may you change, revise or replace any of the Skrivr intellectual property found on the website, either in its entirety or parts thereof.
Skrivr grants you a limited, nonexclusive, nontransferable, revocable license to use the software of the Service, solely to access the Service. Your license to use the software is automatically revoked if you violate these Terms in a manner that implicates our intellectual property rights. We reserve all rights not expressly granted in these Terms. You may not reverse engineer or decompile the Software, nor attempt to do so, nor assist anyone else to do so.
We will respond to notices of alleged copyright infringement if they comply with applicable law and are properly provided to us. We reserve the right to delete or disable content alleged to be infringing and to terminate repeat infringers. Notices of alleged copyright infringement on the Services can be sent to email@example.com.
When you set up your Skrivr account you ask Skrivr to connect to Dropbox, and Dropbox to send a token to Skrivr on your behalf ("User Token"). User Token's are generated by Dropbox, your User Token is unique to you and kept by Skrivr for as long as you keep your account with us. If you terminate your account with Skrivr, your User Tokens are deleted as well.
In addition to the User Token Skrivr will provide you with a password to you Skrivr account. Your password will be used to login and manage your Skrivr account. The password has nothing to do with the Dropbox connection and is only used when you login at Skrivr. The password is encrypted, we can not access it. The encryption ensures that your password cannot be "reverse-engineered" and consequently we can never provide you with your password if you forget it. In such case you must replace the lost password with a new one.
You are responsible for safeguarding the password that you use to access the Service and you agree not to disclose your password to any third party. You are responsible for any activity using your account, whether or not you authorized that activity. You should immediately notify Skrivr of any unauthorized use of your account.
Personal Data and Privacy
In order to register and use the Service we might ask you to provide us with personal data, such as for example:
- Your first and last name,
- your e-mail address,
- your mobile phone number
- your country of residence
By providing Skrivr with personal data as defined above, to the extent permitted by law, you give Skrivr permission to use the data to provide you with information on your account, news on the Service, contests organized by Skrivr, special offers on the Service to your e-mail address or similar messaging system, and you allow Skrivr to adjust the content and advertising on its website to your personal data as described above.
If your contact information, or other information related to your account, changes, you must notify us promptly and keep your information current.
Skrivr will not transfer any personal data to third parties, except such trusted third parties which Skrivr has appointed to carry out the processing of the data. Any third parties engaged in processing of personal data on behalf of Skrivr will be obliged to comply with any local personal data regulation and a high level of security.
Skrivr is a strong supporter of and believer in human rights, free speech, democracy and the citizens' right to access public information, but to such extent applicable law enforces Skrivr to act against illegal content on Skrivr, Skrivr reserves its right to hand out information to law enforcement bodies, such as if a court or prosecutor order enforces us to do so.
Skrivr stores personal data collected from members for such period as is prescribed by applicable law. During this period personal data are only used to the extent permitted by these Terms and by applicable law as well as for the security of users, that is, in order to prevent, investigate, uncover and prosecute potential crimes against any of our users.
If you want to know what information Skrivr process about you or have other questions about your personal data, you are welcome to contact us at firstname.lastname@example.org. You can cancel your approval for handling and saving your personal data. In that case email us at email@example.com. Please note that this means that your account on Skrivr is canceled as a result.
Limitation in liability
Skrivr is not responsible for the accuracy, completeness, appropriateness, or legality of files, user posts, or any other information of the Service.
You are yourself responsible for maintaining and protecting (such as back-ups) all of your content on the Service. For security and back-up purposes we advise you to study the terms of Dropbox. Skrivr (neither by itself or its licensors, agencies or other representatives) makes no express, implied or statutory representations, warranties or guarantees in connection with the Service (including Dropbox), including without limitation the Skrivr content and third party content. To the extent permitted by law, Skrivr does not provide any warranties against viruses, spyware or malware that may be installed on your computer.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Skrivr, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL (INCLUDING LOSS OF USE, DATA, BUSINESS, OR PROFITS) DAMAGES, WHETHER OR NOT Skrivr HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES; (B) AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES MORE THAN THE GREATER OF $20 OR THE AMOUNTS PAID BY YOU TO Skrivr FOR THE PAST THREE MONTHS OF THE SERVICE.
Termination of account
Skrivr has the right to terminate your account if you violate these Terms or the regulations on Skrivr's website or if you have not logged in to your account for 12 months or more, if you fail to pay for the Service or, in the unlikely event that the Service cease to operate.
You may terminate your account at any time from your settings page.
Third party sites
The Services may contain links to third-party websites or resources. Skrivr does not endorse and is not responsible or liable for their availability, accuracy, the related content, products, or services. You are solely responsible for your use of any such websites or resources. Also, if we provide you with any software under an open source license, there may be provisions in those licenses that expressly conflict with these Terms, in which case the open source provisions will apply.
These terms shall be governed by the laws of Sweden, any conflicts with members and Skrivr shall be settled by the Stockholm District Court as first instance.
